As far as I'm aware, they're not Imperial Grenadier guard's which mean's he can use this just so long as he doesn't use our tags 1er_Gren. However like I said they arn't Grenadier's so I don't see a problem here.
We cannot own the name "1er" it just mean's first in french, as many of you know I'm sure.

If you don't change your name you will be denied being put on the official regiment list and may face a possibility of being banned from certain events.

There are tons of 1ers. However no one can specifically own the 1er name since it means "first" in french. I know the 1er Grenadiers already said that as long as they don't use the same tags as them they are fine with it.
