How does copyright even work with this era I mean these songs are so old anyone can use them right?

the songs are not copyrighted however they are being preformed by a group and that version of the song is copyrighted.

Wrong. This is a variation of the actual song, other bands have their own version aswell, eg the 97th regimental band's version of the Union battle cry of freedom.
